How much is paid for downtime?

If the work stoppage is caused by the employer, the worker must be paid at least the MMA in proportion to the duration of the stoppage. If the employer declares a partial stoppage, the remuneration shall be calculated on the basis of the hours actually worked and the duration of the stoppage.

This means that the worker does not lose all income, even if the employer is temporarily unable to provide work. This protection is particularly relevant in the manufacturing, logistics and construction sectors, where downtime is more common.

Practical example:
If a worker worked 3 hours a day and was idle for 5 hours, the salary is calculated on the basis of the actual 3 hours + the 5-hour idle rate.

When can downtime be unpaid?

Cases of fault on the part of the employee

If the downtime is caused by the worker’s fault – for example, if he or she is absent without good reason, refuses to carry out the work, or loses the necessary permits – the employer may not pay for the downtime.

In all cases, the employer must issue a stoppage order, which clearly states:

  • the reason for the downtime
  • the duration of the downtime
  • the arrangements for payment for downtime

This protects both parties and avoids disputes.

Social security during downtime

The period of downtime counts as length of service, so the employee must:

  • no loss of pensionable service
  • continued entitlement to sickness benefits
  • no loss of social security

This is very important for people who have little work experience or are approaching the length of service requirements for retirement.
